Prior to, and during the family law mediation process, each party has their own perception as to what they are entitled, what they perceive to be fair, and what is in the best interest of minor children that are involved. It is not uncommon for one or both spouses to try to "gain an upper hand" in an effort to "win at all cost" simply out of spite.
Effective family law mediation requires a calm, yet strong voice of reason. When attempts to resolve specific issues prior to a scheduled court hearing are unsuccessful, an experienced attorney will present your arguments to the judge with the same calm voice of reason to show his or her client's argument has merit, and deserves serious consideration when the court renders it's decisions.
One of the goals of family law mediation is to help make the parties involved understand that compromise for various issues may be essential in reaching a successful marital agreement through mediation, thus taking the power away from the courts to make rulings for those involved.
